This Terms of Service (“Agreement”) is a legally binding contract between you (“User”, “you”) and Silveroak REI LLC, doing business as PowerSell.org (“PowerSell”, “we”, “our”, or “us”), governing your access to and use of the website PowerSell.org and any associated services, software, content, offers, promotions, data collection tools, or communications (collectively, the “Services”).

The following is a typical example of the type of SMS message used exclusively for real estate wholesaling outreach:

"Hey [Lead Name], this is Christopherwith Silver Oak REI LLC — we’re looking to buy your property.

If you’re open to a cash offer or want to hear what we could pay, just reply ‘YES.’

If you’re not interested, reply STOP to opt out of future messages."

This message is strictly used in the context of real estate wholesaling and lead generation. All such messages are designed to be compliant with A2P 10DLC regulations, the Telephone Consumer Protection Act (TCPA), and related carrier standards. We do not send unrelated marketing content through this messaging stream.

2.2 MESSAGE FREQUENCY & CHARGES

Message frequency will vary depending on your activity with PowerSell (e.g., signups, participation in campaigns, use of platform features). Standard message and data rates may apply depending on your wireless provider. You are solely responsible for any fees incurred from your provider.

2.3 OPTING OUT

You may opt out at any time using the following methods:

SMS/MMS: Text “STOP” to cancel, or “HELP” for customer support

Email: Click the “unsubscribe” link located in the footer of any email

Note: Opting out of certain types of communication may limit your access to important features, including password resets, appointment confirmations, or promotional offers.

2.4 A2P 10DLC COMPLIANCE INFORMATION

PowerSell.org complies with all industry standards related to A2P (Application-to-Person) 10DLC messaging as required by U.S. mobile carriers. We verify all opt-ins and register our sending numbers to ensure deliverability and compliance.

3. USER ACCOUNTS

All trademarks, logos, content, code, videos, images, product designs, and brand assets appearing on or through PowerSell.org are the exclusive property of Silveroak REI LLC and are protected by U.S. and international intellectual property laws. You may not reproduce, distribute, or exploit any content without express written consent.

6. PROHIBITED CONDUCT

You agree not to:

Use the Services for unlawful or fraudulent purposes

Violate any local, state, national, or international law or regulation

Post or transmit harmful, abusive, obscene, defamatory, or objectionable material

Reverse engineer, copy, or modify any part of the Services

Use bots, scrapers, or other automated systems

Attempt to bypass security mechanisms

Harass or interfere with other users

7. INCOME DISCLAIMERS

PowerSell.org may reference potential earnings, affiliate commissions, or other financial outcomes. These are examples only. We do not guarantee any level of income or success. Actual results will vary based on individual effort, business model, and market conditions.

9. DISCLAIMERS

The Services are provided “AS IS” without warranties of any kind, express or implied. We do not warrant that the Services will be uninterrupted, secure, or error-free. We disclaim all liability for damages arising from your use or inability to use the Services.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Silveroak REI LLC shall not be liable for any indirect, incidental, consequential, or punitive damages resulting from your use of the Services. Total liability shall not exceed the amount paid by you (if any) in the past 12 months.

12. TERMINATION

13. GOVERNING LAW & DISPUTE RESOLUTION

These Terms are governed by the laws of the State of South Carolina, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Beaufort County, SC. Any claim must be brought within one (1) year after the cause of action arises.
